Peter Smith is my gg-gpa Peter Wierzelewski who married Franciszka Banicka, same man. He never *legally* changed his name to SMITH, but he used it almost exclusively after coming to America. His son, Stanley Walter Wierzelewski, was the first to legally change his name to SMITH, but he was born a Wierzelewski in Poland shortly before the family's migration to Minnesota. Stanley's children were all SMITHs and none of them ever used Wierzelewski. The one exception is his first daughter, Helen, who died in childhood - she is buried using the surname Wierleske, but nobody really knows why. I think all the children were religiously baptized as Wierleske, but it wasn't their legal name and they never used it.
